Bless FERC - there are a number of important orders that have come out late Friday so I will be doing a supplemental report on Monday. However, please note... Chair Hebert announed that J. Mark Robinson will head the Office of Energy Projects replacing Dan Adamson. Mark has served as OEP director of Environmental/Engineering Review since 1999. He joined FERC in 1978 and has held various posts since then. Robert Cupina is to serve as Deputy Director, having most recently served as Director of the Division of Rates/Tariffs Central. What is interesting here is that the Chief ALJ is requesting guidance from the Commission to determine whether there should be a more complete record regarding any possibility of affilate standards. The case is far more complex than originally anticipated in the March 28 order (with 17 days of hearings, three linear feet of exhibits and 2,700 pages thus far in testimony. Six rebuttal witnesses remain to be heard from and it is anticipated the hearing will continue all next week)Due to the complexity, Chief ALJ Wagner recommends that the parties be given thirty days from June 8, 2001 (July 9) for filing proposed findings of fact and initial briefs. Further, the reply briefs should be filed no later than July 24, 2001. The ALJ on the case will issue the initial decision within 30 days after reply briefs are filed.
