We are seeking gas supplies under GISB Exhibit A "Transaction Confirmations" for Firm Baseload, Firm Flex, and Firm Peaking. Due to PNMGS' portfolio requirements, PNMGS requests the Offers be made on a monthly basis. PNMGS MAY ACCEPT ANY OR ALL MONTHS CONTAINED IN YOUR OFFER(S). This year our bid solicitation is being conducted by e-mail. For security purposes, we need all executed documents to be returned by telefacsimile at (505) 241-2383 or by mail, 414 Silver Avenue SE, Albuquerque, NM 87102-2610. You may submit an Offer(s) of any type and as many variations of Offer(s) for each contract type. Multiple Offers may be submitted on photocopy of the GISB Exhibit 'A' "Transaction Confirmation" Offer form. PNMGS desires contractual flexibility in greater supply quantities, delivery points, basins and pipelines, therefore, the greater assortment of options submitted, the better opportunity of acceptance. PNMGS MUST RECEIVE YOUR WRITTEN GISB EXHIBIT 'A' "TRANSACTION CONFIRMATION", BY TELEFACSIMILE OR MAIL, ON OR BEFORE AUGUST 1, 2001. ONCE AN OFFER(S) IS MADE IT CANNOT BE WITHDRAWN AFTER SUBMITTAL. PNMGS WILL ADVISE YOU BY WRITTEN NOTICE (TELEFACSIMILE OR MAIL) OF YOUR "OFFERS" ACCEPTANCE OR REJECTION ON OR BEFORE AUGUST 9, 2001. ALL OFFER(S) ARE IRREVOCABLE AND INCORPORATE BY REFERENCE THE STANDARD TERMS AND CONDITIONS FOR THE APPLICABLE TYPE OF CONTRACT. THE GISB EXHIBIT 'A' "TRANSACTION CONFIRMATION" SHALL BECOME THE GAS PURCHASE AGREEMENT, IF ACCEPTED BY PNMGS. THE PARTY EXECUTING EXHIBIT 'A' MUST BE AUTHORIZED TO BIND THE COMPANY.
